These Terms of Service ("Terms") govern your use of realestatealex.com (the "Site"), operated by Real Estate Alex ("we," "us," or "our"), and of our referral service. By using the Site or contacting us through it, you agree to these Terms; if you do not agree, please do not use the Site.
Our referral service
Real Estate Alex is a referral service, not a real estate broker, agent, lender, or buyer. We introduce homeowners to buyers in their area. We don't set prices, make offers, appraise, or negotiate, and we don't represent you or the buyer. Homeowners pay us nothing; buyers pay us for introductions, so we have a financial interest in homeowners choosing to sell to a buyer we introduce.
Offers come only from buyers
Nothing on the Site, and nothing we tell you, is an offer to buy your property, an appraisal or valuation, or a price, and none of it should be relied on as one. Any offer to buy your property can come only from a buyer, after that buyer has seen the property. Subject to state law, an offer generally becomes binding only under a separate written agreement between you and that buyer, which we do not sign and are not bound by. We do not guarantee that any buyer will contact you or make an offer, or what any offer will be.
Buyers act for themselves
Each buyer is a separate business acting on its own account. We do not employ, control, or supervise buyers, and we are not responsible for what they say or do, including any offer, timeline, or decision. Whether to deal with a buyer, and on what terms, is your decision.
No agency relationship, and no advice
You and we do not become partners, employer and employee, or agent and principal because you use the Site or our service, and we owe no fiduciary or brokerage duty to you or to any buyer. Nothing on the Site is legal, financial, tax, or real estate advice. Advice of that kind should come from a lawyer, accountant, or other adviser you choose.
Using the Site
To use the Site or ask us for an introduction, you must be 18 or older. When you tell us about a property, you confirm that you own it or are authorized by its owner to ask about selling it, and that what you tell us is accurate. You agree not to disrupt the Site, access it without permission, collect data from it by automated means, or give us someone else's personal information without their consent.
Your privacy
Our Privacy Policy explains how we collect, use, and share personal information, including sharing your details with buyers who pay us for introductions. You can opt out of that sharing on our Do Not Sell or Share My Personal Information page.
Text Messaging (SMS) Communications
If you give Real Estate Alex your phone number through realestatealex.com, or text us first, we may send you text messages (SMS) about your inquiry and about introducing you to buyers for your property. This section explains how that works.
How consent works
Providing your phone number in the chat on this site and ticking the consent box, or texting us first, is how you opt in to receive text messages from Real Estate Alex at that number. Consent to receive text messages is not a condition of using our service or of any purchase. Consent applies only to the person who provided the number, and you can withdraw it at any time as described below.
Messages from buyers
Once you tell us about a property, buyers in your area, who pay us for introductions, receive your contact details (your phone number among them) and the property information you gave us. Any of those buyers may then contact you directly, by phone or by text. Their messages are not sent by Real Estate Alex. Your consent to texts from Real Estate Alex is not shared with or transferred to any buyer and does not cover their messages, and you can tell any buyer to stop contacting you at any time.
Message frequency
Message frequency varies based on your activity and the situation you contact us about. You should expect no more than about 4 messages per week from us. Message and data rates may apply.
How to stop messages
Reply STOP to any text message from us at any time to opt out. Once you reply STOP, we will send no further text messages to that number, aside from a one-time confirmation that you have been unsubscribed. Replying STOP stops our messages only; to stop us sharing your details with buyers, use our Do Not Sell or Share My Personal Information page.

Carriers, including mobile network operators, are not liable for delayed or undelivered messages.
No warranty
We provide the Site, its content, and our service "as is" and "as available." We make no warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not promise that the Site will be uninterrupted, error-free, or secure, or that any introduction will lead to a sale.
Limitation of liability
To the fullest extent permitted by law, Real Estate Alex and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Site, our service, or your dealings with any buyer, even if advised of the possibility of such damages. For any claim connected with the Site or our service, the most we will owe you is the amount, if any, that you paid us.
Indemnification
If someone brings a claim against Real Estate Alex because you misused the Site or broke these Terms, you agree to cover our resulting losses and costs, including reasonable legal fees.
Intellectual property
The text, graphics, logos, and other content on the Site are owned by or licensed to Real Estate Alex and are protected by applicable intellectual property laws. You may view and share pages of the Site for personal, non-commercial use, but may not copy, reproduce, or republish Site content for any other purpose without our prior written permission.
Third-party links
The Site may link to third-party websites we do not control. We are not responsible for the content, accuracy, or practices of any linked site, and including a link does not imply our endorsement of it.
Governing law
Delaware law governs these Terms, without applying its conflict-of-laws rules. Nothing in these Terms limits any right you have under a consumer-protection or privacy law that cannot be waived by agreement.
Severability
If a court finds any part of these Terms unenforceable, every other part still applies.
Changes to these terms
These Terms can change. A change takes effect when we post the updated Terms on this page, and the "Last updated" date at the top shows the latest revision. If you keep using the Site after a change, you accept the updated Terms.
